Terms of Use of the «Alpha Comfort» Software
These terms (hereinafter referred to as the «Terms of Use») constitute a legally binding agreement between you (the User) and AlphaDegree AC Trading LLC, UAE, Dubai, Al Mararr Area, Sultan Bld, office 302 (hereinafter referred to as «AlphaDegree»), regarding your use of the Alpha Comfort software (hereinafter referred to as the «Software»). These Terms of Use represent the entire agreement between AlphaDegree and you. They supersede all other terms, conditions, and stipulations you may have provided, and the rights of the parties are governed solely by the provisions, terms, and conditions of this document.
By using this Software, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you are not permitted to use the Software in any manner whatsoever.
Use of the Software
In accordance with these Terms of Use, AlphaDegree grants you a free, non-exclusive, and non-transferable license to use the Software on devices with a compatible operating system (OS), strictly for the purpose of remote monitoring and controlling your AlphaDegree equipment, in any country within Europe, the Middle East, and Africa (where available).
These Terms do not grant any additional usage rights beyond those listed above. In particular, you acknowledge that resale, sale, rental, or export of the Software in any form whatsoever is strictly prohibited without AlphaDegree’s prior written permission. You may not copy, reproduce, modify, transmit, or distribute the Software or any part thereof, nor facilitate such actions by third parties, except as expressly permitted under these Terms of Use. You may not disclose any information about the Software in violation of applicable laws.
If you download, install, and/or use the Software as an application on an Apple device, you agree to comply with Apple’s applicable terms, available at http://www.apple.com/legal/terms/ , and/or any other third-party terms applicable to your use of the Software.
If you download, install, and/or use the Software as an application from Google Play Store, you agree to comply with Google Play Store’s applicable terms, available at http://www.google.com/mobile/android/market-tos.html , and/or any other third-party terms applicable to your use of the Software.
Pursuant to these Terms, downloading, installation, and use of the Software are performed at your own expense and on your own device.
Through this Software, AlphaDegree may distribute its own advertising materials or those of third parties.
Account Registration
You may be required to register an account in order to activate certain features of the Software.
AlphaDegree considers any use of the Software as being performed by the registered user. Under no circumstances shall AlphaDegree be liable for any damages resulting from violations of registered account usage rules or unauthorized use of your account by third parties due to errors you made in managing your registered account.
Use of Specific Software Features
Certain Software features require an active Internet connection. You are solely responsible for obtaining and paying for such access under the terms and tariffs set by your mobile operator or Internet service provider.
You hereby acknowledge and agree that the Software transmits anonymized data to the Rights Holder regarding your precise location and movement parameters, as well as the location of your equipment’s Wi-Fi adapter, obtained from your GPS device, or your approximate location determined by the active cellular tower of the mobile operator whose SIM card is currently used in your mobile device, for the purpose of collecting statistical information about the Software’s performance.
All usage data transmitted under these Terms of Use is stored and processed in accordance with the Privacy Policy available at: https://alphadegree.ae/confidentiality-politics .
The Software allows you, at your sole discretion, to add custom data to the Alpha comfort application, including the number of devices, equipment models, text labels, etc. (hereinafter referred to as «User Objects»). Adding User Objects does not alter the original data and is permitted solely for your convenience in using the Software.
You alone bear full responsibility and risk for the placement of User Objects, their legal compliance, content, completeness, accuracy, and reliability. The Rights Holder assumes no liability for the designation or description of any User Object, does not confirm or deny its legal compliance, accuracy, or truthfulness, and reserves the right—without notice and at its sole discretion—to remove any User Object or set of User Objects if the description contains unlawful content, inappropriate language, or otherwise violates the License, the terms of other services provided by the Rights Holder, or in order to protect the interests of the Rights Holder, its users, or third parties. The Rights Holder does not guarantee the preservation of User Object data in any scope or for any duration, including in the event of changes due to Software updates or evolution.
The Software provides you with the functional ability to remotely configure your equipment, subject to the capabilities offered by the Software.
Copyright
AlphaDegree owns or is licensed to all intellectual property rights in the Software and its content. You acknowledge that you acquire no intellectual property rights other than those expressly granted in these Terms of Use.
Trademarks / Trade Names
All trade names and trademarks mentioned in this Software (if any), currently or in the future owned by AlphaDegree, are or shall remain the exclusive property of or licensed to AlphaDegree or its affiliates. Your use of the Software does not constitute, directly or indirectly, the grant of any license or right to use any trade names or trademarks mentioned herein.
Disclaimer of Warranty
AlphaDegree has compiled this Software (including its translations) based on information available to it. The Software (and its content) is provided for informational purposes only and is not binding upon AlphaDegree. AlphaDegree does not warrant that the Software is error-free. THE SOFTWARE AND ITS CONTENT ARE PROVIDED “AS IS,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, REGARDING COMPLETENESS, AVAILABILITY, ACCURACY, OR RELIABILITY OF THE SOFTWARE, ITS CONTENT, OR THE PRODUCTS AND SERVICES DESCRIBED HEREIN.
The Software is subject to inherent limitations, including possible design flaws and programming errors. All risks related to the quality and performance of the Software are entirely yours, and you are responsible for verifying that the Software meets your intended purpose prior to any use (beyond basic testing).
Limitation of Liability
By using this Software, you acknowledge and accept that you do so at your own risk. You agree that under no circumstances shall AlphaDegree or its affiliates—including employees, subcontractors, agents, representatives, consultants, installers, or any similar parties—be liable for any loss, damage, injury, expense, business interruption, loss of commercial information, production halt, or computer failure that you or any third party may suffer as a result of using the Software and its content, even if AlphaDegree was or should have been aware of such possibility. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALPHADEGREE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING COSTS, EXPENSES, OR LOSSES ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE AND/OR INTERPRETATION OF ITS CONTENT.
Indemnification
You hereby release AlphaDegree and its affiliates from any claims arising from loss, damage, injury, expense, business interruption, loss of commercial information, or computer failure that you or any third party may suffer as a result of any act or omission by AlphaDegree or its affiliates, whether due to negligence, use or inability to use the Software, or any other cause related to your use of the Software.
Modifications
AlphaDegree reserves the right, at its sole discretion and without prior notice, to periodically release new versions of the Software (with changes to functionality or interface) to replace prior versions or to update the Software’s content.
AlphaDegree reserves the right, at its sole discretion and without prior notice, to periodically amend these Terms of Use. You are responsible for reviewing the current version of the Terms of Use each time you access and use the Software.
Data Protection
Prior to using the Software, your AlphaDegree equipment’s Wi-Fi adapter will automatically register your IP address to enable communication between the server and the adapter. AlphaDegree collects this personal data only at the time you download and use the Software. By doing so, you demonstrate interest in its content, and your personal data may therefore be accessible to AlphaDegree’s marketing personnel, its affiliates, and/or independent third parties, who may use it to inform you about the Software or its content and/or for anonymized analytical purposes within marketing and commercial activities—for example, to assess usage patterns across different countries/regions. We will not use your personal data for any other purposes.
Miscellaneous
The provisions of these Terms of Use also bind your successors, administrators, legal representatives, and any persons you authorize.
Except as expressly stated herein, if any provision of these Terms of Use is held to be invalid or unenforceable, such invalidity or unenforceability shall not affect any other provision, and all unaffected provisions shall remain in full force and effect. In such cases, you agree to attempt to replace each invalid or unenforceable provision with a valid and enforceable one that most closely reflects the original intent and meaning.

AlphaDegree makes every effort to protect personal information from unauthorized access when using the Alpha Comfort application. The AlphaDegree web server stores data voluntarily provided by users when filling out forms and data collected automatically.
